Technically: Kick Messages, CSay's,etc should not be used to issue a KOS.

You’re right. But to follow a KOS through a kick message is asinine too. Realistically all parties are at fault (well except for Squishy).

Okay, so here's what I see. In the most basic terms, a traitor false KOSd an innocent, which they are allowed to do. The way it was done caused no harm done to the round besides a traitor intentionally causing an RDM, which they are allowed to do. The traitor was alive when it happened, which does not seem to be ghosting, and the innocents had no reason to follow the KOS other than the words of the person. 

If anybody should be punished for this, in my opinion, it should be the person that killed Squishy, not Mallack. There are plenty of other times where people have kicked themselves and said "X is a traitor, kill them." and the server just ignores it because its a joke. In this case, joke or not, a traitor called a false KOS while he was alive and somebody followed it.
